Rental Guarantor: Role, Conditions, and Solutions in 2026

What is a guarantor and what is their legal role?

A guarantor (or surety) provides financial security to the landlord. By signing the agreement, they promise to cover monthly rent payments, service charges, and any potential damage to the property caused by the tenant, should the tenant stop paying while the lease is in effect.

Imagine a father in Rennes signing as a guarantor for his daughter as she begins her undergraduate studies. He thinks he is doing her a favor—and he is. However, he has also put his own assets on the line, sometimes for thousands of euros. Many people only realize the full extent of this commitment when they receive that first registered letter.

Simple surety vs. joint and several surety: a crucial distinction

With a "simple" surety arrangement, the landlord must first pursue the defaulting tenant and exhaust all legal avenues before turning to the guarantor. This process takes months. Needless to say, hardly any landlords accept this type of arrangement.

A "joint and several" surety (*caution solidaire*) works the other way around. The landlord can contact the guarantor directly as soon as a single euro of rent goes unpaid, without having to prove the tenant is insolvent. This is the arrangement almost invariably required by landlords. Be sure to check for the term "solidaire" (joint and several) before signing, as it transforms a conditional commitment into a debt that is immediately due and payable.

What the commitment covers and for how long

The agreement covers monthly rent, service charges, occupancy fees, and the cost of restoring a damaged property. The scope therefore extends beyond just the monthly rent amount—a fact that often comes as a surprise to families.

Finally, there is the question of the timeframe. If the written agreement specifies an end date—for example, three years—the commitment expires at that time. If no end date is specified, the commitment is indefinite; while it can be terminated, the cancellation only takes effect at the end of the current lease period. In other words, you cannot decide in November to be released from the obligation in December.
